Can I sue you? Very poor service

    Raissah

      Hi Globe,

I have been a subscriber for over a year now, was impressed until recently. A cuple of months ago, my internet is disconnected everytime say 3 min and cannot make outgoing calls and can't receive incoming calls on my landline. Called the CSR a million times and they just verified my account is active and provided me with a job order number then nothing happened.

It's been 2 months now! Can I sue you guys for giving us very poor service?

Anyone is free to sue Globe.

I was in the verge of suing Globe sometime in 2002 or 2003 for another issue when lawyers of both sides were able to avert the situation and reach a compromise.

I suggest that you exhaust all efforts first before suing as it will take a lot of your time, effort and of course, money.... After giving up with the usual Customer Service, report your concern to the NTC. If it is not resolved then I won't blame you if you sue them.

Just try to quantify your damages and make your demands very clear so you can have a good case. Expect to have preliminary hearings, mediation hearings and if the case pushes through, the judge would resort to a Judicial Dispute Resolution before actually hearing the case out.

Would it be worth it? Only you can answer that but the wealth in knowledge on how the dynamics go around inside Globe at least during that time was something I did not imagine.

You have a very poor case. I bet you'll lose the case if you sue them. Intermittent connection is something inevitable in a service that uses Tower signal to provide internet. Service reliability depends on the location. And your contract (which you signed and agreed with) with Globe states that Globe is not responsible for any untoward damage to your wellbeing/lifestyle due to loss of service.

I highly suggest you call Globe again and make sure to explain the situation.
